I think you are probably right with respect to the  Digital Millennium 
Copyright Act (DMCA). After  having accepted, perhaps unwittingly,  the 
T's&C's in the EULA,even if the more egregious ones don't hold water, 
then a subsequent attempt by the user to disable or remove the copy 
protection software could be obviously viewed as an attempt to 
circumvent the DRM protection.
